| thats why i have BIG disclaimers in my P-N-P rides and i also posted that bikes on the streets are the same as cars. you certainly CAN get tickets while riding that count the same as an automobile.
dont kill a cop, my brother and friends are cops.... instead, obey the law or own up to your disobedience... when i ride my P-N-P i have Helmet, lights, and i ride sane without chances and i dont draw attention to myself. i dont go out with intentions on breakign the law, i jsut ride within my tolerances and have fun. | |

I recall reading that thread and seeing the guy pretty pissed off, but it sounded reasonable to me - got caught drunk on the public roadways and got busted for it. While it would be nice to have a slightly lesser punishment for drunk biking, as it is less dangerous to others than driving, biking drunk on the road, or even just poorly on the road is still dangerous and can still cause increased risk of harm to others, even in cars. What if a car swerves to miss a bike that comes out of nowhere and goes into a pole or off into a ravine? We still have to be very careful biking, even though it's more for our own sake and less for others' compared to driving. | |

| I would expect you would get your license suspended, and it is ridiculous.
The DMV can pretty much do what they want.
They'll suspend your liscense for NOT getting a DUI.
Happened to a friend of mine - he got arrested on a bogus arrest and charged with a DUI, got a lawyer and fought it and won. I'll never understand that - the same lines as how you can be found not guilty in a criminal court but still face civil penalties. It seems like if a court of law with the power to decide your guilt or otherwise decides that you are not guilty of the crime with with you are charged, you shouldn't face any legal consequences from that. Otherwise, what's the point of the court of law if they're not good enough that their conclusion means anything (minus appeals of course, as mistakes will happen - maybe things like dmv suspension or civil penalties should have to file some sort of appeal to say that court screwed up and they should still recieve dmv/civil penalties for whatever reasons) | |
